Scrapbook News and Review Magazine's 2010 Terms of Publishing
Please note that our terms have changed as of September 1, 2010.
Upon submittal of your artwork, you agree to allow Scrapbook News and Review Magazine to use your projects including, without limitation, all text, graphics and photographic images for publication in or in connection with Scrapbook News and Review Magazine. Such projects include scrapbook pages, cards, mini albums, mixed media, and/or other paper crafting items.
Scrapbook News and Review Magazine agrees that you will receive an amount of monthly subscriptions to Scrapbook News and Review Magazine based on the following criteria: one to four layouts = 1 month, five to eight layouts = 2 months and anything above 9 layouts = 3 months worth of monthly subscriptions. Each issue is currently valued at $4.99. Confirmation of free issues will be electronically sent to you at time of publication debut.
We reserve the right to showcase your artwork for a minimum of six months, but only retain exclusive rights for a period of 30 days after the publication date of the magazine issue you're to be featured in. It's important to note that while we have the right to continue publication of your artwork in our magazine, we will never have ownership of your artwork and you're free to post on other sites after the 30 day period.
By accepting the Terms of Publishing, you agree that you are the sole owner of the artwork, that it is original and has never been published by another publication (but can previously be posted on the internet), that the artwork contains no matter unlawful in content or a violation of the rights of any person or entity, that you have the full power to grant such rights, that permission to publish has been granted by all persons pictures on your artwork, and permission to publish has been granted by all photographers, if any, whose work is incorporated into your projects.
This agreement supersedes and replaces all prior oral and written agreements or understandings of the parties. All prior understandings or discussions, unless set forth herein, are of no legal effect. Photographic rights agreements executed in connection with this agreement as contemplated immediately above shall be construed to be part of this agreement.
This agreement is entered into in the State of Michigan and shall be governed by the laws of the State of Michigan. Any action brought to enforce the terms of this agreement shall be brought in the State of Michigan, and you agree to consent to jurisdiction and venue in the state and federal courts in Michigan.
